SUMMARY:

The theme of public sector innovation has attracted the interest of justice organizations in order to achieve greater levels of efficiency and effectiveness in the provision of their services. In this context, understanding innovation in the Judiciary is as a relevant topic that lacks investigation. Aiming to contribute to fill in this research gap, this work, supported by the Resource-Based View and the Dynamic Capabilities approaches, proposes to identify and measure the main factors associated with innovation capacity in the Judiciary. From the systematization of recent scientific literature, an explanatory theoretical model is proposed, encompassing Leadership, Innovative Behavior, Collaboration, Organizational Resources, Knowledge Management, and Information Technology. The theoretical and practical implications of the model are discussed, and six propositions are stated to be tested through empirical research. Subsequently, two more research phases will be carried out, with a mixed approach. In the second phase, with a qualitative approach and supported by interviews it is proposed to investigate the perception of judges and civil servants of different Brazilian judicial courts regarding the innovation process in the Judiciary, aiming to identify factors that influence the development and adoption of innovations in these institutions. Data from this phase will be analyzed using content analysis techniques with the support of one or more appropriate software for analyzing interview data. In the third phase, quantitative, will be built and validated a scale to map these factors on a survey with judges and civil servants of Brazilian Judiciary. The data collected on this survey will be analyzed using univariate and multivariate statistical techniques, such as descriptive statistics, Confirmatory Factor Analysis - CFA and Structural Equation Modeling - SEM. Afterwards, it is expected that academic and practical contributions can be evidenced and that the research carried out would contribute to the development of science in the field of Justice Administration.
